1. Scope of Application

These Terms and Conditions apply to all orders placed through our online store by consumers and businesses.
The version valid at the time of your order shall apply. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

The applicable law is Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

3. Conclusion of Contract

The presentation of products in our online store does not constitute a legally binding offer but a non-binding online catalog. By clicking the “Checkout” button, you place a binding order for the products in your shopping cart.

Once your order is submitted, you will receive an order confirmation email. This email confirms receipt of your order but does not yet constitute acceptance. The purchase contract is concluded only once we send you a separate shipping confirmation or upon dispatch of the goods.

4. Prices and Payment Terms

All prices are listed in Euro (€) and include the applicable Austrian VAT.

Shipping costs are added separately during checkout and are clearly displayed before the final order submission.

Delivery times:

  • Austria: 2–4 business days

  • EU countries: 3–7 business days

All shipments are handled by DPD.
Tracking information will be provided once your order is shipped.

We are not liable for delivery delays caused by force majeure or external logistic disruptions.

6. Right of Withdrawal

Consumers within the EU have a legal right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period starts from the day you or a third party (not the shipping carrier) receive the goods.

7. Retention of Title

All goods remain our property until full payment has been received.

8. Warranty and Liability

We offer the legal warranty rights as applicable under Austrian and EU consumer protection law.

In case of any defects, please contact us at: info@105-degrees.com within 7 days after receiving the product.

We are not liable for minor negligent breaches of duty, provided that these do not relate to essential contractual obligations.

9. Returns and Refunds

You may return items within 14 days of delivery, provided they are unused, unwashed, and in original condition.

Return shipping costs are to be paid by the customer unless the return is due to an error on our part.
